All plans represented on this website are protected by the Federal Copyright Laws under the Architectural Work Copyright Protection Act of 1990. The original home/building designer retains title and ownership of the original plan documents and retains the copyright in the plans, which includes the right to control copying and alteration of the plans as well as construction of any structures based on the plans. To the extent plans are licensed for single or multi-use, the plans may not be resold or used by any other person. The designs or portions thereof contained in the plans may not be copied, reproduced, modified, or used in any way without a license granting such rights purchased through Forever Home Plans. It is also illegal to create derivative works or have plans, renderings, or sketches drawn based on these plans without written permission.
Copyright protection of home plans for construction respects and supports the intellectual property of the original architect or designer. Willful infringement could result in statutory damages in an amount up to $150,000 plus attorneys’ fees, damages, and loss of profits.
Copying and Modification Rights
To obtain the right to copy or modify a home plan, a license must be granted to utilize such plan by Forever Home Plans. This license will include an electronic DWG and (or) PDF file. Copies can be made as needed for the construction of structures allowed per the license granted. Any other copying is unauthorized. The Buyer may be held legally responsible for any copyright infringement that is caused or encouraged by the failure to adhere to the terms of the license. The license granted also includes the limited right to modify the plans to meet specific needs, and/or any code, ordinances, or regulatory requirements of a specific state or local jurisdiction. Modification of the plans does not exempt the plans from copyright protection. Forever Home Plans and the original owner of the copyright are not liable for any consequences arising from a Buyer’s modification of the plans.
All rights of ownership, title, and interest in the plans and derivatives thereof remain with the original copyright owner. Modified plans are considered derivatives of the original and receive the same copyright protection even if completely redrawn.
The Builder’s Responsibility
The builder shall be responsible for ensuring that all work is in accordance to the latest edition of all applicable national, state, and local building codes. The builder will need to field verify all conditions prior to and during construction. The builder will also need to verify all dimensions and details of the plans for overall accuracy appropriate to the local conditions and final selection of materials that can affect both dimensioning and detailing.
